Terms & Conditions

1. General

These terms and conditions apply to all quotes, assignments and agreements between Rowanlogo ("Rowanlogo") and the client. The client's own purchasing or general terms are explicitly rejected. By accepting a quote or placing an order, the client agrees to these terms.

2. Quote and assignment

A quote describes what will be designed and at what price, and is valid for 14 days unless stated otherwise. An assignment is established once the client accepts the quote in writing or by email. Work outside the quote is discussed beforehand. Where a quote deviates from these terms, the quote takes precedence.

3. The design process

A logo starts with an idea. Based on the wishes discussed, I work out initial concepts and sketches, process feedback and refine the chosen design into a final result. The exact process and number of feedback rounds are stated in the quote.

4. Feedback and approval

The client is given the opportunity to give feedback, preferably bundled together as much as possible. Changes within the scope of the assignment are included. A design is considered final once the client explicitly agrees to it. Major changes, a different direction, or additional designs requested after approval are considered additional work and are always discussed beforehand.

5. Payment

The agreed price is stated in the quote. Invoices have a payment term of 14 days unless otherwise agreed. The final files and the transfer of rights follow only after full payment. In case of late payment, Rowanlogo may suspend work and charge statutory interest and collection costs.

6. Copyright and transfer

Copyright applies to a design made by Rowanlogo and arises automatically with the creator. Payment does not automatically mean this right is transferred. After full payment, Rowanlogo transfers the economic rights to the final, approved logo to the client, who may then freely use, adapt and apply the logo. Sketches and concepts that were not chosen remain with Rowanlogo and may not be used without prior permission. Moral rights remain with the creator by law.

7. Use and adaptation of the logo

After full payment, the client may use the final logo without restriction for their own business, for example on their website, social media, print materials and other business communications, and may adapt it themselves or through a third party. Rowanlogo is not responsible for the quality or correct use of the logo after delivery or adaptation.

8. Delivery

Upon completion, the client receives the agreed files digitally, usually in common formats such as SVG, PDF, PNG and EPS. The exact files to be delivered are stated in the quote; other files can be provided on request, potentially for an additional fee.

9. Portfolio and use by Rowanlogo

Rowanlogo may use a final design for its own portfolio, website, social media and other promotional purposes. If the client does not want this, we will make separate arrangements in advance.

10. Client-supplied materials and third-party materials

The client is responsible for supplying necessary information and materials on time; late delivery may affect the planning. If used fonts, images or other third-party materials require additional licensing, this is discussed beforehand.

11. Cancelling an assignment

If an assignment is cancelled after acceptance, the work carried out up to that point is invoiced; for an already (partially) completed project, the full agreed amount may be due. Concepts made before cancellation may not be used without permission.

12. Liability

Rowanlogo carries out every assignment with care and is not liable for damage arising from the use of the delivered design, or from changes made by the client or a third party after delivery. Liability is limited to the amount paid for the assignment, except in cases of intent or deliberate recklessness.

13. Complaints and force majeure

A complaint about the work delivered can be submitted in writing within 14 days of delivery, with a clear description of the issue. If Rowanlogo is unable to meet an obligation due to force majeure, the assignment will be temporarily postponed as needed.

14. Privacy and confidentiality

Confidential information is not shared with third parties without permission. Personal data is only processed to the extent necessary for the assignment, administration and contact with the client.

15. Final provisions

Rowanlogo may amend these terms; for new assignments the terms in force at that time apply, ongoing assignments are not retroactively changed by a new version. Dutch law applies to all agreements; a dispute is first resolved through consultation and otherwise submitted to the competent court.
